Competitions

If you are planning to run a competition at Curtin the first thing you need to do is to see if it falls within the definition of a "trade promotion lottery" as defined under the Gaming and Wagering Commission Act 1987 (WA). Most of the competitions run at Curtin will fall within this definition. A trade promotion lottery is defined as:

"a lottery conducted to promote the sale of goods or the use of services, in which every participant takes part -

(a) without cost to him; or

(b) by reason of the purchase of goods or the use of services, the cost of which is no more than the cost would be without the opportunity to take part in the lottery".

If for example, you are offering students a laptop as a prize for taking part in a survey you will have to make sure the competition is conducted in accordance with the requirements under the Gaming and Wagering Commission Act 1987 (WA). If you are running a lottery designed to encourage participation in research surveys, it is unlikely that it would fall within the definition of a “trade promotion lottery” within WA. However, we encourage that as a matter of best practice, you follow the process set out in the Competitions Toolkit. Take note also of the requirements to apply for permits if your survey does not exclude participants from other States in Australia.
